READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participation in the activity of Rock Climbing, Ice Climbing, Mountaineering organized by Summit Ascents International, of 390 30th St. Boulder CO 80305 and/or use of the property, facilities and services of Summit Ascents International, I agree for myself and (if applicable) for the members of my family, to the following:

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Summit Ascents International, or the employees, representatives or agents of Summit Ascents International.
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Summit Ascents International for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Summit Ascents International, whether caused by the fault of myself, my family, Summit Ascents International or other third parties.
3. INDEMNIFICATION. I agree to indemnify and defend Summit Ascents International against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Summit Ascents International.
4. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Colorado law.
5. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.
6. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
7. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.
8. ARBITRATION. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law.
9. HOLD HARMLESS. The signer shall fully defend, indemnify, and hold harmless Summit Ascents International from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever ( including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of Summit Ascents International, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers . This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorneys' fees, and related costs or expenses, and any reimbursements to Summit Ascents International for all legal fees, expenses, and costs incurred by it.

I understand that there are Inherent hazards and risk, and understand the following list is not limited:

1. Risk of injury in Mountaineering, Rock, and Ice Climbing is significant including the potential for permanent disability and death.
2. Injuries from falling may occur from exposure to high altitude, which may affect judgment and coordination, or from not paying close attention to your climbing or others climbing with or near you.
3. Injury to extremities such as hands, fingers, feet and toes. This could include inflammation and/or strains of muscles, ligaments, and/or tendons, nerve damage or compression, and broken bones.
4. Broken bones, severe injuries to the head, neck, and back which may result in severe physical impairment or even death.
5. Equipment failure from SAI Guides equipment, my own or others’.
6. Cold weather and heat related injuries like but not limited to:
- a. Frost bite, frostnip, hypothermia
- b. Heat exhaustion or heat stroke
- c. Sunburn, and dehydration.

Photography, Video and Drone Release
I as a participant in SAI Guides programs hereby grant to the SAI Guides the right to take photographs, video and/or drone footage of me as a participant in any/all SAI Guides programs. I understand that SAI Guides can copyright, use and publish this media both electronically and in print. I grant SAI Guides the right to use this media for any lawful purpose, including but not limited to publicity, illustration, advertising, Web content, and any other forms required for their marketing and management.

This is to certify that I, as Parent, Guardian or Temporary Guardian consent and agree not only to his/her release of all Releasees, but also to release and indemnify the Releasees from any and all liabilities incident to his/her involvement in these programs for myself, my heirs, assigns, and next of kin.
